As everyone following this blog knows, I have been working for over one year to try to get documents from Homeland Security. The documents requested included the sworn statement taken from David Chaney regarding the assertion by Shailey Tripp that she was introduced by Todd Palin to Mr. Chaney, for the purpose of providing sexual services. In an effort to avoid the necessity of filing a lawsuit to obtain these documents, and because Homeland Security indicated an investigation was underway, I proposed that I would refrain from filing a suit, in exchange for a redacted statement of Chaney. The statements of Chaney I specifically requested were any statement he gave pertaining to the meeting with Todd Palin and Shailey Tripp, and the services provided by Shailey Tripp thereafter.

As I was working with an attorney to prepare the Original Petition for filing in Federal Court, I received yesterday a letter from A.T. Smith, the Deputy Director of the U.S. Secret Service, a Division of Homeland Security, proposing a resolution, similar to my letter of June 25th. Mr. Smith has agreed to provide, within 5 days, the statement of David Chaney concerning the allegation that Todd Palin introduced him to Shailey Tripp and the assertion that he engaged in sexual relations for money with Shailey Tripp. In consideration for the voluntary production of this information, I have agreed not to file suit, and for a period of 6 months to refrain from filing any new FOIA requests with the Secret Service or Homeland Security pertaining to David Chaney, Shailey Tripp, Sarah Palin, and Todd Palin.

Obviously David Chaney may have denied the allegations of Shailey Tripp, whether he was being truthful or not. However if he admitted that the meeting took place and that Shailey Tripp provided sexual services to him, we will finally have independent proof of the allegations of Shailey Tripp that Todd Palin was her pimp. It is unclear when and how the documents will be provided to me, but as soon as I receive the statement of Mr. Chaney from Mr. Smith, I’ll advise everyone reading.

Thank you for your support over the last year as I have fought to obtain these documents.

  2. I am awestruck. Does your agreement not to file suit address other issues, or is it limited to not filing suit over their unwillingness to provide this document?

      The agreement is that I agree not to file suit on the current FOIA claims and that I’m agreeing to withdraw my FOIA requests and I can’t refile or direct another to re-file within a period of 6 months. If the documents are produced, and Chaney denies the assertions of Shailey Tripp, I have agreed not to pursue this matter or direct anyone to refile for 6 months. If a news station decides on their own to file a similar FOIA request to mine I am obviously not in a position to direct what they do, and I can’t agree for them not to file a similar request.

I do so hope that you get an accurate read, but heavily redacting a statement full of lies seems par for the course – although why they continue to protect a PIMP is totally beyond me.   3. That’s great news Malia! I cant wait to see if he told the truth. But, I do have concerns with them requesting that you not file again for 6 months. Isn’t October the deadline for prosecution if it is to happen? Hopefully it means they are actually investigating with the intention of doing something.

      The problem is that if I filed a suit, I can imagine a scenario whereby I still wouldn’t get the documents until AFTER the statute would run, so at least we have a chance this way to see if Chaney implicated Todd,and if he did, then I can bring this to the attention of Sean parnell, and it will be really hard not to bring charges against Todd then.

      I’m guessing that the real request they are worried about related to my second request that related to retirement benefits being paid to Mark Sullivan and David Chaney after their resignations. I have agreed to withdraw those requests at this time, and they don’t really have a reason not to produce those documents.

        I don’t have any way of knowing what Chaney said, and the fact that Mark Sullivan testified that the Colombia matter was an isolated event, would indicate that Chaney lied when asked about Shailey Tripp. However the fact that Homeland mysteriously began an “investigation” after they looked closely at these documents gives me hope that Chaney told the truth. My appeal to Homeland to produce the statement of Chaney regarding the meeting with Shailey Tripp was based on the fact that those facts are already in the public domain due to Shailey Tripp’s statement, so that would not interfere with a pending investigation. I am hopeful that there really is a pending investigation, and the Homeland is about to bring charges, so maybe now they aren’t so worried about producing a statement of Chaney as that would be discoverable in a proceeding against Todd Palin. We just won’t know anymore until the statement is produced, but we will know something in 5 days!

      2. Todd will never be brought to justice – there is no incentive to do anything about him and his and his wife’s crimes. Parnell has been in bed with Sarah for years – if he doesn’t have her support, he will lose his office.

      Absolutely, I DO NOt KNOW what his statement will say, and I can only hope and guess that he told the truth, and confirmed what Shailey has said. I have two reasons to be hopeful that he told the truth. First Todd and his attorney failed to respond to my letter asking for a denial of the allegations, and second, the fact that Homeland started an “investigation” suggests to me that there was something in Chaney’s statement that merited an investigation.

He might have because (1) he was under oath, and he might be more concerned about perjury than anything else, (2) i KNOW THAT AN INVESTIGATION was underway, so what were they investigating if Chaney didn’t admit what was going on? and (3)chaney might be wanting to help his buddies who are trying to show that this happened all the time and the supervisors knew it and looked the other way!

IT would seem that if they are providing and releasing damaging info that at the same time we would hear about indictments, arrest etc. If the information that we do have and know about is true then this goes way beyond our interest somewhat. Alaska especially because of that being the crime area in question and the years of palin corruption.

    1. That is my concern as well. It isn’t just the Palins – the Parnell regime is Palin Redux – he got the job via Palin and she can take it away just as easily. The fact that Sarah’s husband is a fulltime pimp isn’t actually a big crime – from a legal point of view – especially in Alaska. But it just indicates that all the corruption is deeply entrenched – and it is highly unlikely anyone would really make a serious attempt to clean that place up.
      Parnell depends upon the largesse of Sarah – the Government depends upon Todd’s Hookers to grease all those lovely political skids for the visitors and office holders.

Sorta “we will give you one little morsel IF you agree to several things in return” just to quiet a potentially embarrassing (to them) inquiry.       It is probably difficult for the HS to hire non-partisan staff and obviously illegal to ask one’s political leaning in an interview, but I’d bet my retirement that the vast majority of their employees are conservatives as well as numerous extreme conservatives. Wouldn’t be the least surprised to learn there’s an old man in AZ paying rapt attention to this matter and offering to ‘help’ in any way he can.

        I know they aren’t trying to help me, and will do only what they have to do to not embarrass themselves, but if Chaney did confirm Shailey Tripp’s story, then they may be investigating the Palins right now. I figure some information is better than nothing, and surely they know that I’m not going away if what they give me is a flat out denial of Chaney.   9. Hmm. Eleventh-hour cooperation, finally. The fact that they stalled until that point would tend to indicate that confirmations of Shailey’s statements are contained therein. In addition, the six-month moratorium on FOIA requests would tend to indicate that there really is an investigation ongoing and it will be completed and possibly go public within that time frame.

    That’s my interpretation; I sure hope it is true.

        they really have nothing to lose by publicizing Chaney’s statement, as I think they’d have to provide it in discovery to Todd in any criminal proceeding, and we already have Shailey’s statement that it happened in the public domain, so they really aren’t disclosing anything new. Chaney might have known more about Todd’s prostitution business than Shailey knew, and they aren’t producing that, so there is still a level of secrecy pending the outcome of the investigation.

      4. Thanks. I was looking at Shailey’s statement as as an allegation, and Chaney’s statement as confirmation (or denial) of that allegation. Shailey’s statement (and book) were ignored by the press, and if Cheney denied it, I don’t see that getting any coverage either. But surely the press could not ignore a confirmation by Cheney that Shailey Tripp was telling the truth about Todd, and that in fact the goober “First Dude” was really was a slimy pimp who had arranged for a prostitute for the secret service agent that was protecting his own wife. If nothing else, it will prove that the McCain campaign did no vetting of that family whatsoever.

    If there is anything in the documents that you get that positively state that Todd provided services via Shailey, then Palin will be forced to deal with it.

    I doubt $arah will shut up forever, being a true sociopath, but at very least this will be a major blow to her cred with the ultra right, and will further marginalize her. Fox may even drop her from their roster, which would be very satisfying.

  12. I’m sorry Malia, this sounds as if The Deputy Director of the U.S Secret Service is still trying to manipulate you. The information you have requested is public information which should be released after receipt of a
    FOIA request. Government entities have been stalling and downright refusing the release of this information for over a year. Now upon being theatened with a lawsuit they want to make a deal to release “portions” of Chaney statements. I’m sure portions means “nothing meaningful”. Why does the Deputy Director want you to wait six months before filing any new FOIA requests and agree not to file a lawsuit ever regarding this matter? Is there a statute of limitations date that falls within that six month time period? It sounds like this deal is the only way for the Secret Service to keep you from legally getting all of the information you deserve.

      Your concerns are mine too, but the reality is that I could file suit and there is no guarantee that a judge would give me anything, or if he did, when I’d get it. I’m not precluded from filing a new request in 6 months, and if they claim then that an investigation is still underway, I am hopeful that a judge woule be less forgiving if its been such a long time that they have had to bring their investigation to a conclusion.

        She wasn’t wearing a scarf / scarves while hiking in Juneau with Scott of AlaskaHDTV or when speaking with a blond woman in Juneau at the mansion on February 06, 2008 – but was wearing a scarf on February 19th & February 25, 2008 and in every photo thereafter until the “birth”.

        P.S. – In my opinion, in the Feb. 19th photo Palin has that “cat that ate the canary” look about her. In fact, she looks very smug and self-satisfied.

      I’m hoping that what they are trying to protect relates to a national problem. For example what if Chaney testified that he’d been using prostitutes throughout his career,and everyone knew it , and nobody cared. That would make me as a lawyer for Homeland want to find a way to make me go away, and if I had to sacrifice Todd Palin in the process, I’d do it in a heartbeat! Since it is the statement of Chaney that is at issue, I doubt he knows much about Todd other than his involvement with Shailey.

      You are very observant. The ones I have filed only related to Todd, so I’m thinking that the pending investigation may relate to Sarah as well. I can imagine a scenario where they are investigating her PAC under the FEC rules and things they charged the PAC for that related to Todd’s pimping business. Of course I don’t know but I am willing to wait and see if they bring charges.

  22. Malia, this is wonderful news! I understand your reasoning for going along with their conditions, but as Alan noted above, it is quite interesting that they would impose such conditions on releasing information that the the public is entitled to see. It’s also curious that they would include Sarah on the list of restrictions, when your FOIA request did not ask for any information about her specifically (as far as I know).

    It seems to me that if Chaney lied and did not implicate Todd, there would have been no reason to deny your requests, especially once they realized you were serious about filing a lawsuit. If there was nothing incriminating in the documents, they could have gotten rid of you much sooner by releasing them. If they were concerned about the retirement benefits part, they could have left that out or dealt with it separately. Waiting until the eleventh-hour, and then effectively cutting a deal with you, is what makes this so intriquing.

    I suppose it’s possible that Chaney lied about Todd in his statement, but subsequently came under investigation for something prostitution related, possiby much bigger than Todd Palin. But if that were the case, they know a judge would most likely rule in their favor, and they would not need to be cutting deals with you now. All I can say is, next week can’t come soon enough, and I am keeping my fingers crossed!

      I know that filing suit might have eventually gotten the documents, but I know the Courts are hesitant to interfere with a pending investigation, and if the investigation is of Sarah or Todd Palin, I don’t want to interfere with their efforts. This way we get the documents sooner, and if they are not what I expect, I can re-file in six months, and then it would be harder for the government to say that they need more time to complete their investigation.

    Worst case scenario: he lied, or they are giving you something without much info. Good to know. Not a defeat, considering all the surrounding stuff we know.

    Best case scenario: someone is (as you say) willing to let the chips fall where they may re the Palins because the is less interest in protecting Palins, less interest in the Palin rebuttals which surely include dirty laundry about others, less interest in covering up the details of the 2008 election.

    So this will be a win IMO not matter which way it goes, thanks to your work. Just supporting Shailey is good, and bringing a procurer to justice — that’s enough for me. But of it accelerates the tick, tick, tick of the erosion of the Palin hoax and other crimes coming to light, that would be a bonanza.

There really never should have even been a battle to get that information unless of course THEY are being truthful and there is an investigation involving one or all of the above mentioned scoundrels because that is what they are!.   32. Here is what I think is one of the biggest factors in hindering you to get to the truth. It could be John McCain. He’s been in the senate 40 years or so. How would it look if the VP he picked had a husband who was pimping? That man has a lot of power and is as crooked as a corkscrew.

    I’m a “babygate” person, Malia, but I applaud your efforts to nail the Palins through the criminal justice system. My frustration comes from the fact that no one ever holds them accountable! Let’s hope all your work has not been in vain.
