Sarah Palin’s Attorney Threatens Suit Against the Anchorage Police Department


John Tiemessen is the attorney for Sarah Palin who asked the Anchorage Police Department to issue a press release to the National Enquirer. That press release has come under great scrutiny as it was false and misleading.  The press release of the Anchorage Police Department regarding Todd Palin and his involvement with prostitution was directly opposite to the records of the Anchorage Police Department. Thus even though it was John Tiemessen who asked that the APD issue a press release there is nothing preventing him from THREATENING to sue the APD for publishing false information, even though he asked them to do it.The “threat” of a lawsuit is made for publicity, but not for the purpose of getting at the truth. To threaten a suit is a way to attack the truth of the statements in Joe McGinniss’  book by innuendo. Tiemessen is suggesting that it’s just guilt by “innuendo”, but he is the one making the “innuendo.”

Tiemessen has NOT really threatened the APD. I just made that up. The purpose is to illustrate just how easy it is to generate a headline, and/or to threaten a suit.  He could have threatened to sue Ronald Reagan or Mickey Mouse and a suit against either would be just as likely as a suit against McGinniss. It is the actual pursuit of a suit that is the critical consideration. If you threaten a suit, you might make headlines, and people immediately question the truth of the assertions in McGinniss’ book, without proving that they are in fact not true. By Palin having her attorney make this threat, it is not even Sarah or Todd Palin going on record to say that anything in McGinniss’ book is untrue. If a lawsuit was actually being contemplated, an astute attorney would never THREATEN suit. Instead he would gather as much evidence as possible, and then simply FILE suit. Especially in the case of a slander or libel suit, where proving the truth of the matter in question is the critical consideration, gathering evidence first would be critical.

In the case at hand consider the type of evidence that would be relevant if Sarah Palin should actually file a suit alleging that the information reported was untrue. The attorneys for Joe McGinniss would be entitled to take the following depositions (where the witness would be sworn to tell the truth, under penalty of perjury):

1. Glen Rice: He would be required to answer detailed questions about the sexual experience he had with Sarah Palin. While most of us would NOT want to know the details, certainly Sarah Palin would not want disclosure by Glen of how he rated this experience and just how accomplished Palin was in the sack.

2. All people in the Wasilla community that might have ever seen Sarah and/or Todd snorting cocaine.

3. Any and everybody who might have knowledge of the truth about Trig’s birth mother. Chapter 19 of Joe’s book related to the rumors that Trig is not Sarah’s child. Mr. McGinniss would have the subpoena power of the Courts to take the depositions of Cathy Baldwin Johnson, nurses at the hospital, and even require a DNA test of Sarah, Todd, and Trig. It would be a dream come true for thousands of people around the country, if Sarah and Todd Palin would be forced to testify under oath about whether or not Sarah concocted the entire Trig birth story!

4. Sarah and Todd Palin – Of the many outrageous things that Sarah and Todd have said over the last three years, such a suit would require each of them to be put under oath, and to testify. We have proof that they lie. They have each lied so often that it might be hard for them to remember the truth. If you lie to the press you just look like a fool. We know what that looks like.If you lie under oath, you go to prison. We haven’t seen that in the case of Sarah and Todd Palin, but they haven’t had to answer questions under oath. Remember in the Troopergate matter that Todd Palin simply ignored the subpoena to appear and testify?

Todd may have avoided testifying in that matter, but he would not be able to ignore his responsibility to testify if he would be the Plaintiff in a suit against Joe McGinniss.  He could have been arrested and jailed by the Judge in that matter. If a suit were filed by the Palins alleging slander or libel, the judge would require them to appear and give testimony. They would be REQUIRED to answer questions under oath. You might not have criminal exposure if you bring impermissible pressure on a state employee to fire another, but there are criminal sanctions for lying under oath.  It is Joe McGinniss that has the real slander suit against the Palins for calling him a child molester.

Imagine for a minute one simple question: “Is Trig your natural-born son?” “Have you ever used cocaine?” “Did you ever have sex with Shailey Tripp?” “Did you ever give Shailey Tripp cash?” “Did you ever get a massage from Shailey Tripp?” “Did you represent in any written document to Shailey Tripp that you were not pregnant, when you have represented to the entire country that you were pregnant at that time?”

Thus a suit will never be filed. Tiemessen can threaten all he wants, but we know that Todd and Sarah will never allow themselves to be placed under oath and answer any questions.

      Probably not , since all the attorney said was that they were contemplating a suit. Anything said between the attorney and Palin would be protected by attorney/client privilege, and all they would have to say is that they really were considering the option of a suit, even if they ultimately decided not to file.

      Just checked amazon.com list of Hot Sellers. Did it yesterday afternoon for the first time and Joe’s book was at #69. Just now it is at #50. That is a pretty big jump, I would say, so must be tied to this threat of a law suit.

      ON the overall Best Seller list it is #85. Yesterday I could not find it on that list, but today it says it has been in top 100 for 11 days. So, I am not sure about that. BUT, it does have an up arrow which seems to mean it is gaining.

      So, it looks like you are correct that it has probably helped.

      I’m sure that McGinnis promised them anonymity to get them to talk to him. The only way that would change is if a Judge ordered him to disclose the names of his sources, and then he might do that. Palin would never want that. Moreover, the fact that Joe named people like Glen Rice shows that he is not afraid of what Rice would say if subpoenaed to testify. Bring it on!

  5. So….how will you spin this bs if and when she does file suit? Filing a lawsuit is expensive both for the plaintiff and the respondent. Often the threat of a law suit is enough to stop further action such as publishing a book full of inaccuracies but then that’s not the purpose of your little missive here, is it.
    All you are interested in is the same thing Joe McGinnis is interested in and that is to throw as much crap at the Palins in hoipes that some will stick.

There is no way she could win this lawsuit (which I am convinced she has no intention of actually filing – she has a long history of threatening lawsuits that never appear). Gord, this so-called threat does not specify that any conditions be met in order to avoid a lawsuit (such as demanding that they cease publishing a book full of inaccuracies – your words), making it nothing more than an amateur publicity stunt. Any lawyer reading a letter worded like this would know that Palin has no intention of suing. In other words, there no threat here whatsoever, but low information people (most of the supporters she has left) will jump to the conclusion that the book must be full of lies or Palin would not be suing. I’ll bet that when she is asked about the book on Fox, she will say that she can’t discuss it for legal reasons. How convenient for her. But hey, keep on sending in your lunch money to SarahPac. Plastic surgery upkeep is quite costly, and pretty soon it will be Willow’s turn to ruin her good looks.

    Palin threaten lawsuits all the time. The only successful one, to my knowledge , involved the young man who hacked into a Palin email account. She is a public figure. She has opened herself up to unauthorized bios and anything else in the public domain. Joe McGinniss did not make up things out of thin air. He reported facts and statements from those who knew/know the Palins/Heaths. Palin is a frightened little nothing – of no importance in this great and grand world.

    Palion can no longer intimidate anyone outside of her own tight, small, shrinking world. She is a total disaster, fraud and failuire.

  7. I have some experience with defamation law. In fact, one does not “file suit.” The appropriate form is to state the facts of the case along with the case law that supports it, make a good faith effort to resolve the issue without litigation and give the person or company responsible for the offense a set amount of time to respond. You demand a “cease and desist.” You demand a “correction.” You demand a public apology. You demand some resolution that will put the matter to rest. You don’t demand a phone call to discuss. That’s why this letter from Palin’s lawyer seems both curious and toothless – they “may” file suit. “booga booga” Palin is such a silly woman.

        Summary Judgment is a motion the Defendant would file if they didn’t want to do discovery. It is usually filed when there is no real question of fact. In this case I bet McGinnis’ attorney would WANT to do discovery, so they would not file the summary judgment motion until all depositions had been taken and until all results were back from the DNA testing.

  9. If memory serves, Todd was subpeonaed in the Troopergate investigation and refused to show up. Bristol blatantly lied in the e-mail hacking trial. Nothing was done. The chances of ANY of these people ever doing any kind of time for their blatant lies not only speaks to their character but to the sad state of the judiciary system. No wonder Sarah said, “I’ll do this until the courts say I can’t.” There’s no punishment.

  13. The whole point of that “release” was to get into circulation “Palin threatened to sue the publisher.” And the reason for THAT is to plant the seeds of “she must have something on them” in the minds of those who don’t pay much attention.

    Well, I DO pay attention, and the first thing I noticed was that Palin’s shyster didn’t mention even ONE of these supposed lies in his letter. All he did was rebroadcast an email that was provided to him by an alcoholic liar that simply does not lead to any conclusion about what was actually published. There’s nothing here.

    But…. there doesn’t have to be anything here. That’s not the point.

      the reason they are not any lies, is that Joe was reporting what was told to him! Obviously he didn’t have personal knowledge of watching Palin cocaine use, but was reporting information told to him. Thus even if someone lied to him, he is only the messenger.

By using the leaked email as “evidence”, it would seem they are implying that McGinniss could find no sources to confirm the “lies” reported to him by Gryphen, and others, but included them in the book anyway. Of course we know that only the stories he could confirm made it into the book, and we also know (as does Sarah) that there are no lies told in the book. I wonder If she thinks she can somehow force the publishers to reveal the identify of the anonymous sources without having to be deposed herself.

Now, I do have a legal question … if this is a bona fide letter from a legitimate legal firm, how can they state in the first sentence that they represent Governor Sarah Palin? She has not been a governor for over two years. Should they not just state : we represent Sarah Heath Palin? I would think it would be illegal to misrepresent who you represent,eh? Is this a silly question? The fact that she is still referred to as Governor by so many just really irks me, but in this case I think it is legally wrong. That is why I think even the letter “threatening to sue” is bogus!

    Let’s talk about how realistic a threat that letter from Sarah’s lawyer to the publishers at Crown Books. Another blog discovered that the number to which the lawyer’s letter was faxed was a fax line for submissions. The standard form for a business letter is to address the person, followed by a colon. In the lawyer’s letter, the name of the publisher is followed by a comma. Some of the trolls here have trouble with their punctuation, too, just saying.

    The letter is more for show than it is a real letter from a lawyer seeking some kind of action. A real letter from a lawyer is sent by registered mail, return receipt requested, or by UPS or FedEX, again with signature required. This letter is about publicity for the poor victim, Sarah, who still reacts before thinking. As MA told us, it will take 3 days for Sarah to figure out that she ended up helping Joe’s book sales and brought attention to his book, where some media outlets had canceled their interview with him.

    The other thing that Sarah really can’t do is face up to proving the lies in court. The publisher’s lawyers will want to see Trig’s birth certificate and request a DNA test for Sarah, Todd and Trig. I don’t think that is what Sarah in mind. Crown Publishers’ lawyers vetted the book. There are tapes of people giving the information to Joe. He is reporting on what they said.

    The letter may have secondary value in addition to making Sarah feel a little better about Joe’s book. It paints her as a victim to her loyal fans. She can appeal for donations to a legal defense fund because she won’t spend her own money on this so-called lawsuit. They will donate because they love a good fight, and they see Sarah as a real pit bull.
